Hearing

The exact form of the hearing of the arbitral dispute depends on the needs and preferences of the parties.
The options include:
- a determination based on the papers;
- a determination based on a Court Style hearing with case openings, cross examination and case closings; and
- any other options which facilitate the fair and final resolution of commercial disputes by impartial arbitral tribunals without unnecessary delay or expense.
Venues
- There are a number of suitable venues at which an oral hearing can occur including cross-examination.
- Our Mr White has used the following facilities and found same to be good.
  - Sydney
    - Australian Internatioanal disputes Centre
  - Melbourne
    - The Liberty Group
Limited Time
- Sometimes the parties may agree to limit the time that each party may spend arguing a particular point or cross examining particular witnesses.
- This is known as the stop clock technique.
- Our Mr White prefers not to use stop clock hearings unless the parties expressly agree to same and the terms of use of same.
